Town Announces Tax Takings -- And We Ask....

Subscribing to all sorts of messages from the Town of Franklin, we were much impressed with the legalese that arrived in our inbox this morning:

The owners and occupants of the following described parcels of land situated in the Town of Franklin in Norfolk County and the Commonwealth of Massachusetts, and all other persons are hereby notified that the taxes thereon, severally assessed for the years hereinafter specified, according to the list committed to me as the Collector of Taxes for the Town of Franklin, by the Board of Assessors of said Town remain unpaid, and that said parcels of land will be taken for the Town of Franklin on August 23, 2023, at 10:00 a.m. for the non-payment of said taxes, liens and betterments and the interest, if any, along with all legal costs and charges thereon, unless the same shall be previously discharged.

With lots of attention given recently to so-called equity theft through foreclosures -- a process that has led to people in some municipalities losing the entire value of their home because of owing a few thousand dollars, we wondered whether this was a similar thing?

Ms. Bertone set the record straight, writing to us as follows:

Tax Taking is the process a Collector must use to transfer delinquent taxes over to the Treasurer's books.

Once a demand bill is mailed, and becomes due, I must give public notice (legal ad) and allow 14 days to pay in full before I can exercise the lien. For outstanding FY2022 property taxes the demand bill was mailed on 6/3/2023.

Tax takings are not under scrutiny that I know of. The tax taking is simply the process of perfecting our lien on a property. What is under review is the practice of foreclosing on a property, selling it and keeping the entire proceeds regardless of the amount owed to the town. To my knowledge, we have not done that in the recent past and certainly not during my tenure. I am in a holding pattern until the legislature decides what it wants to do.

The 'equity theft' issue is the subject of both lawsuits and proposed 'reform' legislation on Beacon Hill that State Rep. Jeff Roy has been involved with this year.
