69 MILLIKEN AVE, 5A LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Dirk E. Whitesell to Benjamin Franklin Savings Bank, dated December 20, 2004 and recorded at Norfolk County Registry of Deeds in Book No. 21906, at Page 442, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing same will be sold at public auction at 10:00 AM, on September 14, 2022 on the mortgaged premises being known as 69 Milliken Avenue, Unit 5A, Franklin, MA, being all and singular the premises described in said mortgage to wit: The unit (the "Unit") known as UNIT 5A in the MILLIKEN HILLS CONDOMINIUM A (the "Condominium") located in the building known and numbered as 69 Milliken Avenue (the "Building) in Franklin, Norfolk County, Massachusetts 02038, a condominium established pursuant to Chapter 183A of the Massachusetts General Laws (the "Condominium Law") by Master Deed (the "Master Deed") dated June 18, 1980, recorded on June 23, 1980, with Norfolk County Registry of Deeds in Book 5764, Page 537, as amended by instruments of record. The Unit is shown on the floor plans (the "Floor Plans")of the Building recorded with the Master Deed and on the copy of a portion of the Floor Plans attached to unit deed recorded in Book 5821, Page 491, to which is affixed the verified statement of a registered architect in the form required by Section 9 of the Condominium Law. The By-Laws of the Milliken Hills Condominium A A ssociation (the "By-Laws") and the Rules and Regulations adopted pursuant thereto (the "Rules and Regulations") are recorded with the Master Deed. The Unit is to be used only for residential purposes. 1. The Unit is conveyed together with: (a) An undivided 3.39% interest in the common areas and facilities (the "Common Elements") of the Condominium described in the Master Deed, attributable to the Unit, (b) Rights, easements and agreements described in the Master Deed, the By-Laws and the Rules and Regulations recorded with said Deeds in Book 5746, Page 522 (the "Declaration") and in the By-Laws of the Milliken Hills Homes Association, Inc. and the Rules and Regulations adopted threunder, which are both referred to in the Declaration as any of the same may be amended from time to time pursuant to the provisions thereof; (c) All other rights, easements, agreements, interests and provisions contained in the Master Deed, as the same may be amended from time to time pursuant to the provisions thereof; (d) The provisions of the Condominium Law; (e) Easements, restrictions and agreements of record insofar as any of the same are in force and applicable, and (f) If the Unit is presently a 2-bedroom unit, as shown on the Unit Plan, the easement to use the Storage Area shown on the Floor Plans recorded with the Master deed, as described in Section 4 of the Master Deed. 2. The Unit is conveyed subject to: (a) The rights, covenants, easements, restrictions and agreements described in the Master Deed and in the By-Laws and the Rules and Regulations and in the Declaration of Covenants, Easements and Restictions and the By-Laws of the Milliken Hills Homes Association, Inc. and the Rules and Regulations adopted thereunder, all as referred to in the Master Deed or the Declaration, as any of the same may be amended from time to time pursuant to the provisions thereof, (b) All other rights, easements, agreements, interests and provisions contained in the Master Deed, as the same may be amended pursuant to the provisions thereof; (c) The provisions of the Condominium Law: (d) Easements, restrictions and agreements of record insofar as any of the same are in force and applicable. (e) Real estate taxes assessed against the Land and the Building which are not yet due and payable. Except as otherwise specifically provided herein all rights covenants, easements, agreements, restrictions, provisions and interests recited above shall constitute covenants running with the land and shall inure to the benefit of or bind, as the case may be, any person having at any time any interest or estate in the Unit and his agents, employees, licensees, visitors and tenants, as though the same were fully set forth herein. Being the same premises conveyed to me by deed of Roberta J Larkin dated September 29, 2000 and recorded with Norfolk Deeds, Book 14436, Page 435. The above described premises will be sold SUBJECT TO and with the benefit of all restrictions, easements, covenants, conditions, building and zoning laws, to any and all unpaid taxes, tax titles, water and sewer charges, municipal or other public taxes, assessments or liens, rights of tenants and parties in possession, if any. TERMS OF SALE: A deposit of $7,500.00 DOLLARS shall be required to be made to the mortgagee in cash, by certified or by cashier's check at the time and place of the sale as a deposit.
