COUNCIL THAT: Chapter 185 of the Code of the Town of Franklin is
hereby amended at section §185-20 (E)(2) Illumination by adding the
following text: §185-20 (E)(2). Prohibited Signs 1.
Any signs having a part that moves or flashes, or signs of the
traveling light or animated type, and all beacons and flashing
devices, whether a part of, attached to or separate from a sign, are
prohibited. 2. Except as provided in Section 185-20 (C)(3)(c),
No liquid crystal display or light emitting diode signs are permitted
within the Town of Franklin other
than gas station signs displaying one price and no more than 16
square feet in size. 3. Roof signs, billboard signs,
inflatable signs or banners are prohibited. 4. No flags shall
be allowed with the exception of those permitted in Subsection F(3).
The foregoing Zoning By-law Amendment shall take effect in
accordance with the Franklin Home
Rule Charter and Massachusetts General Law Chapter 40A, Section 5.

IT ENACTED BY THE FRANKLIN TOWN COUNCIL
THAT: Chapter 185 of the Code of the Town of Franklin is
hereby amended at section §185-20 (C)(3) Illumination by adding the
following text: §185-20 (C)(3). Illumination (a) Signs
may illuminated provided that there shall be no glare cast onto
adjacent residential properties or in a manner to disrupt the
movement of pedestrian or vehicular traffic. (b) Signs may be
internally illuminated in all sign districts other than the DCD and
RD, provided that the background is dark in color and the letters are
light in color, or there is an opaque shield between the light
sources and the sign panel that only allows the lettering area to be
illuminated. Canopies or awnings may also be internally illuminated.
There shall be no glare or direct light reaching any adjacent
residential properties or in a manner to disrupt the movement of
pedestrian or vehicular traffic from an internally illuminated sign,
canopy or awning. (c) LED and LCD message boards are allowed
in the Commercial II, Business and Office Zoning Districts, with a
Special Permit from the Planning Board, upon findings that no traffic
safety hazard will be created either by the location of the structure
or its operation and that there will be no light spillage onto public
roadway or any abutting property. The general special permit criteria
set out in Section 185-45 E(3) shall not apply. The Planning Board
may impose such terms and conditions as it deems necessary to protect
public safety. The foregoing Zoning By-law Amendment shall
take effect in accordance with the Franklin Home
Rule Charter and Massachusetts General Law Chapter 40A, Section 5.

-16730 LEGAL NOTICE INVITATION TO BID TOWN OF FRANKLIN,
MASSACHUSETTS FISHER STREET WATER TREATMENT PLANT UPGRADES
PROJECT NO. DWSRF -16730 The Town of Franklin,
Massachusetts requests bids for construction of the Fisher Street
Water Treatment Plant (WTP) Upgrades project. General Contractors and
filed Sub-Contractors must be pre-qualified to bid on the project.
Pre-qualifying was completed prior to public advertisement of this
project and was conducted in accordance with the requirements of
Chapter 193, Section 19 of the Acts of 2004. Sealed Bids for
the General Contract for construction of the Fisher Street Water
Treatment Plant Upgrades will be received by the Chief Procurement
Officer, at the Purchasing Department, Municipal Building, Room 205,
at 355 East Central Street, Franklin,
Massachusetts until 11:30 AM, Wednesday, April 9, 2025 and at that
time and place bids will be publicly opened and read aloud.
Sealed Bids for the filed Sub Contracts designated herein will be
received at the office of the Chief Procurement Officer, at the
Purchasing Department, Municipal Building, Room 205, 355 East Central
Street, Franklin,
Massachusetts until 11:30 AM, Friday, March 21, 2025 and at that time
and place bids will be publicly opened and read aloud. The
project includes furnishing all labor, equipment, materials, and
incidentals required to retrofit the existing Fisher Street Water
Treatment Plant to include replacement of the ozone/ultrafiltration
membranes for treatment of iron and manganese with pressurized
manganese greensand vessels, modifications to the existing chemical
storage area, replacement of the existing HVAC equipment, well pumps
and associated VFDs, backwash supply pumps, modifications to the
existing subslab tanks and integration with the existing SCADA
system. The project also includes furnishing all labor, equipment,
materials, and incidentals required to construct a new PFAS treatment
facility capable of treating up to 1.2 million gallons per day when
all treatment vessels are operated in series. The facility is an
addition to the existing Fisher St WTP and includes concrete work,
two granular activated carbon (GAC) vessels, building construction,
and associated HVAC, plumbing, electrical, and instrumentation and
control (SCADA) work. The Contract Time shall be 590 Calendar
Days commencing thirty days following the Effective Date of the
Agreement. In accordance with M.G.L. Chapter 149, Section 44D,
General Bids will be valid only when accompanied by (1) a current
certificate of eligibility issued by the Division of Capital Asset
Management and Maintenance, showing that the General Bidder has the
classification of Sewage and Water Treatment Plants and a capacity to
perform this work and (2) an update statement summarizing the General
Bidder's record for the period between the latest Division of Capital
Assets Management and Maintenance certification and the date the bid
is submitted. Any General Bid submitted without the appropriate
certificate and update statement is invalid and must be rejected. The
estimated project cost is $16 million. In accordance with
M.G.L. Chapter 149, Section 44F, Filed Sub-Bids will be valid only
when accompanied by a current certificate of eligibility issued by
the Division of Capital Asset Management and Maintenance, showing
that the Sub-Bidders have been certified in their particular Sub-bid
category to participate on public construction projects and to
perform the work required. The Sub-bid shall also be accompanied by a
Sub-bidder Update Statement in a form as developed by DCAMM. Any
Sub-bid submitted without the appropriate certificate and update
statement is invalid and must be rejected. Only those
Contractors and Sub-Contractors who have been pre-qualified for this
project, in accordance with the requirements of Chapter 193, Section
19 of the Acts of 2004 are eligible to bid. Contract Documents
are available for examination online at www.franklinma.gov/bids
after 10:00 AM on or after Wednesday, February 12, 2025. Each
General Bid and Sub Bid shall be submitted in accordance with the
Instructions to Bidders and shall be accompanied by Bid Securities in
the amount of five percent of the bid. The following are the filed
Sub Bids required for this work: 1. Masonry Work 2.
Miscellaneous and Ornamental Iron 3. Waterproofing,
Damp-Proofing and Caulking 4. Roofing and Flashing 5.
Painting 6. Fire Protection 7. Plumbing 8.
Heating, Ventilating and Air-Conditioning (HVAC) 9. Electrical
Work Bidders may not withdraw their Bids for a period of sixty
days, excluding Saturdays, Sundays, and legal holidays after the
actual date of the opening of the General Bids. The Successful
Bidder must furnish a 100 percent Performance Bond and a 100 percent
Payment Bond with a surety company acceptable to the Owner.
Complete instructions for filing Bids and Sub Bids are included in
the Instructions to Bidders. Minimum Wage Rates as determined
by the Executive Office of Labor and Workforce Development under the
provision of the Massachusetts General Laws, Chapter 149, Section 26
to 27H, as amended, apply to this project. It is the responsibility
of the Contractor, before bid opening, to request if necessary, any
additional information on Minimum Wage Rates for those tradespeople
who may be employed for the proposed work under this Contract.
Federal Minimum Wage Rates as determined by the United States
Department of Labor under the Davis-Bacon Act also apply to this
project. The bidding and award of this Contract will be under
the provisions of M.G.L. Chapter 149, Section 44A - 44J. The
Owner reserves the right to waive any informality in or to reject any
or all Bids if deemed to be in its best interest. The work
under this Contract is funded in part by the Massachusetts Clean
Water Trust (the "Trust"). Disadvantaged Business
Enterprise (DBE) goals are applicable to the total dollars paid to
the construction contract. The goals for this project are a minimum
of 4.20 percent D/MBE participation and 4.50 percent D/WBE
participation by certified DBEs. The two low bidders shall submit
completed DBE forms (EEO DEP 190C & EEO-DEP-191C and the DBE
Certification of United States Citizenship form) by the close of
business on the third business day after bid opening. Failure to
comply with the requirements of this paragraph may be deemed to
render a proposal non-responsive. No waiver of any provision of this
section will be granted unless approved by the Department of
Environmental Protection (MassDEP). This Project requires
compliance with the Department of Environmental Protection's (DEP)
Diesel Retrofit Program by use of after-engine emission controls that
are EPA certified, or their equivalent, on all of the off-road
(non-registered) diesel vehicles/equipment, and vehicles greater than
50 brake horsepower, which will be used in the performance of the
